Introduction

Thank you for your interest in joining Labelbox. (“Labelbox,” “we,” “our,” or “us”). When you apply for a job with us, we collect certain personal information in connection with your application. This Job Applicant Privacy Notice (“Notice”) explains how we collect, use, and process information about our applicants (“you,” or “your”) during and after your working relationship with us.

When you navigate to a job application listed on the Labelbox website, you will be notified at the bottom of the job description in the “Your Privacy” section that any information you submit to Labelbox as a part of your application in accordance with this notice. Please note that the submission of your application qualifies as your acknowledgement that you have read this notice and provide consent for Labelbox to process your information for the purposes described in this notice.

This Notice describes the following:

Scope and Applicability

This Notice describes our privacy practices when you apply for employment or are considered for a position with Labelbox.

This Notice does not cover the following:

  • Labelbox Customers – This notice does not cover your interactions with Labelbox outside the context of applying for a position, such as browsing our website to view our products and services or logging into your account as a customer. For more information about how we process customer data, please see our Privacy Notice.
  • Labelbox Employees – Please contact [email protected] to learn more about our privacy practices regarding the personal information of Labelbox employees.

Labelbox does not recruit or hire the following:

  • Children under 18 – We will not process or retain job applications from children under 18, nor do we direct information toward audiences under 18.

Information We Collect

We collect personal information about you during the recruitment process. "Personal information” is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household. This notice also applies to sensitive personal information, a category of personal information. It includes data like your social security number and account log-in credentials. This notice does not apply to information that is not personal, like anonymous, de-identified, or aggregated data (such as hiring summary statistics).

We may collect the following categories of information as part of the application and interviewing process:

  • Identifiers/Contact information, like your name, online identifiers such as an Internet Protocol address, account and usernames, aliases, telephone number, email address, home and postal addresses, signatures, and other identifiers described in the sensitive personal information category below.
  • Categories required to be listed specifically under certain state laws, like name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, education, employment, and employment history.
  • Employment and performance information, including your employment records, work history, work permit status and related immigration information, results of background checks any criminal convictions and offenses in accordance with applicable law, educational information, job application information, and reference contact information along with the information that reference provides about you.
  • Internet or other electronic network activity information, including, but not limited to, your IP address, device ID, location data (collected from your device and/or derived from your IP address), email address, and information regarding interactions with internet websites, applications, or advertisements.
  • Images and recordings of you, like your photograph, voice, audio/video recordings and transcripts of, interviews and/or calls.
  • Geolocation data, including approximate location data based on your IP address.
  • Audio, electronic, visual or similar information, including facial images and voice information like photos, videos, and voice recordings.
  • Education information, such as school attended, GPA, extracurricular activities, and graduation date.
  • Categories of sensitive personal information, including personal information that reveals your social security number, driver’s license, state identification card, or passport number.

Sources of Personal Information.

We receive information about you from the following sources:

  • Directly from you;
  • Previous and current employers;
  • Service providers (e.g., expense reimbursement services, recruiters);
  • Travel partners (e.g., travel agents and portals, car service, and ride share companies);
  • Background check services;
  • Online sources including social networks and recruiting sites (e.g., LinkedIn);
  • Other public sources.

Information about you may also be collected automatically in the following ways:

  • If you applied for a job through a third party, they may collect information about you. For more information, see their privacy policies.

How We Use Information

We use your information when we consider you for job opportunities with Labelbox. For example, we may use your information in the following ways:

  • Communicate with you – We process your personal information to enable you to access and use the Services that you request, including contacting you during the screening and interviewing process and communicate with you through the course of the recruitment process;
  • Evaluate your application for employment;
  • Verify that the information you and others provide is true and accurate, such as for reference checks;
  • Maintain hiring processes – We use your information to provide, operate, monitor, and maintain our hiring processes, such as evaluating your application for employment;
  • Provide and improve necessary functionality – We use your information to provide you with the necessary functionality required during your application process, and to analyze and improve the applicant experience;
  • Promote security– We use your information to investigate and prevent fraudulent transactions, unauthorized access to our systems, and other illegal activities by verifying that the information you and others provide is true and accurate, such as for reference checks;
  • Develop and improve our Services – We process your personal information for legitimate business purposes, such as internally evaluating the recruitment process, submitting reports as required by law, and resolving legal disputes;
  • Legal, Regulatory, Safety and Compliance purposes – We will process your information for purposes of compliance with laws or regulations and to review compliance with applicable usage terms, such as work eligibility in the country of employment;
  • Other purposes – We will process your information for other legitimate business purposes as required by law and determined by us for maintaining an effective hiring process.

How We Share Information

We share your personal information with third parties as required by law and as part of our business practices. We do not share your personal information to advertisers for cross-context behavioral advertising. We only share applicant personal information on a need-to-know basis where appropriate safeguards and contractual arrangements are in place and as described below.

Labelbox Affiliates

We may share your information with Labelbox affiliates. If your personal information is transferred to a party unaffiliated with Labelbox as part of a merger, acquisition, or sale of all or a portion of our assets, we will provide you with notice before transferring your personal information to the new entity.

Service Providers

We work with service providers such as skills evaluation providers and consultants to help us with our recruitment and hiring process. Under contract with Labelbox, these third parties are authorized to use your personal information only as necessary to provide these services or perform them on our behalf.

Public Authorities

We disclose your personal information when disclosure is:

  • Reasonably necessary to comply with any applicable law, regulation, subpoena, legal process, or enforceable governmental request;
  • Necessary to enforce this Notice;
  • Necessary to detect, prevent or otherwise address security, fraud or technical issues;
  • Required to enforce our contractual obligations, including investigation of potential violations; or
  • Necessary to protect against harm to the rights, property, or safety of Labelbox, you, or the public as required or permitted by law.

International Transfers

Labelbox may transfer your personal information to other countries, which may have different data protection laws than the country in which you initially provided the information.

How We Store and Protect Information

We retain your personal information for as long as necessary for us to comply with legal obligations, resolve disputes, enforce rights, or as is reasonably necessary for business.

We use reasonable and appropriate physical, technical, and administrative safeguards to protect your information from unauthorized use, access, loss, misuse, alteration, or destruction. We also require that service providers acting on our behalf or with whom we share your information also provide such security measures under industry standards.

We will get consent from applicants for the collection and use of personal data where such consent is required by applicable law. ** **Please note, failure to provide necessary personal data may disqualify an applicant from employment.

Your Choices

Based on your jurisdiction, you may have the following rights regarding your personal information:

  • Access – You have the right to request access and receive information about personal information we collect, how we use your personal information, and how we share it. This includes the right to request proof of our authorization to process personal information by law or by consent. You have a right to receive this information in a structured, machine-readable format.
  • Correct – You have the right to request correction of your personal information, where it is inaccurate or incomplete.
  • Deletion – You have the right to request that we delete your personal information under certain circumstances.
  • Opt-out of the Sale or Sharing of Information – We do not sell or share applicant personal information to third parties. If you are a user of our products or website, see more information in our Privacy Notice.
  • Limit the Use of Sensitive Personal information – You have the right to limit the use of sensitive personal information collected by us to only uses which are necessary to perform business functions. We only use sensitive personal information for purposes which are necessary to the business, so there are no additional steps to take to limit this processing.
  • Non-Discrimination – You have the right to not receive discriminatory treatment for exercising any of your rights. We will not treat you differently for exercising the rights described above.

Deleting your information will remove you from consideration for employment with Labelbox. You may also request we withdraw your application for a specific position without deleting your information.

Identity Verification

To help protect your privacy and maintain security, we take steps to verify your identity before responding to requests. To verify your identity to make the request and confirm that the personal information relates to you, we may ask for information that appeared on your job application, such as name and submission record.

We will respond to requests within a reasonable amount of time, depending on your jurisdiction. Your request and choices may be limited in certain cases, for example, if fulfilling your request is not permitted by law or if we have compelling legitimate interests to keep your information. Some jurisdictions may place additional restrictions on how we process your personal information and our practices in those jurisdictions may be more restrictive than those described in this Notice.

Depending on the jurisdiction in which you reside, you may have an authorized agent submit an access request on your behalf. If you wish to use an authorized agent, you must provide the party with written permission signed by you. We may deny a request from an authorized agent if the agent cannot provide your signed permission demonstrating that they have been authorized to act on your behalf.

Communication Preferences

You can choose whether to receive optional communications from us by email related to new jobs or roles that become available. In addition to the rights listed above, you may exercise your rights regarding the collection of personal information using the following tools:

  • Cookie controls - Most web browsers are set to accept cookies by default. If you prefer, you can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies, this could affect certain features or services of our website. If you choose to delete cookies, settings and preferences controlled by those cookies, including advertising preferences, may be deleted and need to be recreated.

Changes to This Notice

This Notice may be modified at any time and for any reason. This Notice will be reviewed by the Data Protection Officer on a regular basis and at least annually. Notice revisions will be approved by the Data Protection Officer, Legal, and Human Resources personnel. We will respond to requests within a reasonable amount of time, depending on your jurisdiction. Your request and choices may be limited in certain cases, for example, if fulfilling your request is not permitted by law or if we have compelling legitimate interests to keep your information. If you have unresolved concerns, you may have the right to complain to a data protection authority in the country where you live, where you work or where you feel your rights were infringed.
